1. Acceptance of Terms
By accessing and using Niky's online ordering platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.
2. Ordering & Payment
2.1 Order Placement: All orders must be placed online through our platform. Orders are subject to acceptance and availability.
2.2 Payment: Payment is required at the time of order placement. We accept major credit cards and debit cards processed through Stripe.
2.3 Pricing: All prices are in USD and include applicable taxes. Prices are subject to change without notice.
2.4 Order Confirmation: You will receive an email confirmation once your order is placed and payment is processed.
3. Pickup & Delivery
3.1 Pickup Times: Orders must be picked up during the selected time slot. Late pickups may result in order quality degradation.
3.2 Pickup Requirements: Please bring your order confirmation number. Valid ID may be required for pickup.
3.3 Unclaimed Orders: Orders not picked up within 2 hours of the scheduled time may be discarded without refund.
4. Cancellations & Refunds
4.1 Party Pack Orders: Cancellations must be made at least 48 hours before the scheduled pickup time for a full refund.
4.2 Toddler Tuesday Events: Cancellations must be made at least 24 hours before the event for a full refund.
4.3 Refund Processing: Approved refunds will be processed within 5-7 business days to the original payment method.
4.4 Quality Issues: If you're not satisfied with your order quality, please contact us immediately for resolution.
5. Toddler Tuesday Events
5.1 Registration: Registration is required for all Toddler Tuesday events and is subject to capacity limits.
5.2 Parental Supervision: Children must be accompanied by a parent or guardian at all times during the event.
5.3 Allergies: Please notify us of any food allergies when booking. We handle nuts and other common allergens in our facility.
5.4 Behavior: We reserve the right to ask participants to leave if behavior is disruptive or unsafe.
6. Allergen Information
Our products may contain or come into contact with milk, eggs, wheat, soy, peanuts, tree nuts, and other allergens. While we take precautions, we cannot guarantee that any product is allergen-free. Please inform us of any allergies when ordering.
7. User Accounts
7.1 Account Security: You are responsible for maintaining the confidentiality of your account credentials.
7.2 Account Information: You agree to provide accurate and complete information when creating an account.
7.3 Account Termination: We reserve the right to terminate accounts that violate these terms.
8. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of Niky's and protected by copyright and trademark laws.
9. Limitation of Liability
Niky's shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for the order in question.
10. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of our services after changes constitutes acceptance of the modified terms.
